Farm Pollution Liability insurance is value-added coverage only available to Farm Bureau Member's Choice or AgMax® Commercial Agriculture Insurance policyholders. If all of your farm/ranch property and liability is insured by our companies, this policy can help protect you against a wide range of farm pollution risks, including animal waste, fuel or chemical leaks, dust and additional pollutants that cause bodily injury or property damage for which you are legally liable.
Coverage is for farmers with building capacity for up to 10,000 head of livestock, and who rent or own up to 78,500 acres of land where manure is applied for a full crop year. The annual premium is based on liability limits and the number of acres, head of livestock and building pits, plus any additional charges.
The Farm Pollution Liability policy offers:
Pollution liability coverage — protection against animal waste and other pollution risks, such as fuel or chemical spills and dust, when a pollution incident originates from an insured site.
Protection from lawsuits — if an individual claims bodily injury or property damage resulting from a pollution incident that originates on an insured site as part of your farming operation and you are held legally liable, legal defense costs will be covered up to the policy limits. This policy does not include coverage for odor nuisance lawsuits.
Clean-up costs — pays for clean-up costs up to policy limits if an unintentional animal waste spill results in environmental property damage in or on land of others, the atmosphere or any body of water that is not part of the insured site. Environmental Protection Agency (EPA) fines are not covered by this policy.
Extended reporting period — you may purchase this coverage to provide an extension of the reporting period for claims in the event the policy is non-renewed or cancelled, or you retire. This option extends the reporting period up to one year, and the claim will be treated as submitted on the last day of the policy period, provided the claim is for bodily injury or property damage that occurred before the end of the policy period.
Individuals considered insureds as part of the Farm Pollution Liability policy could include you, your spouse, family members, business partners and their spouses. Executive officers/directors and stockholders are insureds, but only in respect to their duties or liability as stockholders. Employees (other than executive officers) are insureds, but only for acts within the scope of their employment by you. Other individuals may qualify as insureds as outlined in the policy.
